TUPE transfer to Teleperformance



On the 25th February 2025 LBG announced that it will be transferring services and in turn jobs from its BCB COO business to Teleperformance. This transfer is classed as a TUPE transfer, which stands for Transfer of Undertakings (Protection of Employment) Regulations.

 

As part of TUPE the work and workers responsible for doing that work will transfer over to the new employer and existing contractual terms and conditions are protected.

 

The transferable terms that will move over with colleagues include basic salary, working hours, holiday entitlement, notice periods, continuity of service, sick pay and leave maternity/adoption/paternity pay and leave etc.

 

Redundancy terms and associated heritage terms will also remain in place and be honoured. The only way this will change is if a colleague transferring over decides to apply for a role in Teleperformance and in turn changes their contract or if a restructure was to take place in Teleperformance.

 

Unfortunately, the regulations do no cover pensions, so workers transferring over to Teleperformance will leave the LBG pension scheme and can join Teleperformance’s pension scheme but will lose out on the LBG contributions. For non contractual elements the Teleperformance proposition will closely reflect the LBG position but there are elements that they have confirmed they cannot match or provide. This includes GPS, share schemes, some flexible benefits, LBG financial products, and compassionate leave.

 

The Colleague mortgage benefit will remain in place for a period of 12 months after transfer.

We appreciate that this announcement has caused a lot of worry and uncertainty amongst impacted colleagues and we are here to support all impacted members.

 

Your union shares in your dismay with the banks approach to pensions contributions and other terms not being honoured as part of this transfer. We did pushback on this approach with senior leadership and stressed the need to rethink its position many times during formal consultations, but they were unwilling to budge on these as well other non-contractual terms and ultimately, they felt Teleperformance was the right company to do business with.

 

Unfortunately, the TUPE regulations are clear when it comes to the transfer of work under such circumstances, it is not an unlawful practice, and the minimums in terms of protecting contractual terms is being met. Whilst also, safeguarding job security, to prevent possible redundancies in this business area.

 

That said, we know that the loss of key colleague benefits and the uncertainty of moving to an unknown company, when colleagues want to stay with LBG, and how this may play out in the long haul can raise a lot of unknowns and a lot of uncertainty.
